Feeling Disrespected

I thought 9/11 spoke for itself. Let me see if I can discover which year two planes flew into the World Trade Center, one plane flew into the Pentagon and another grounded itself in Pennsylvania and if it was before 2000 I will come back and apologize.

9/11 did the trick, it took a couple of years to come to fruition. Ohio now reports tickets to Michigan, or perhaps only mine because I had a U of M parking pass hanging from my rear view mirror at the time.

Im sorry that after 10 years of risking your life and serving your country you put yourself in a situation where somone else can determine what you can or cannot own ( within reason). Thank you for your service I too served for over 10 years. I pray things start to look up for you!

you should know if it was a felony as you would have either had probation, prison or some form of equal punishments like a drug court for the DUI if it hit felony level. It is funny tho they are pretty lax on clearances, you wouldn't believe the people i had to give them to when i was in the army, what you can do tho is try going to your states clemency board and try to get your 2nd amendment rights back if they have been revoked, i know in FL you can get them back after a felony as long as it wasn't a violent felony it just takes time, i think 5 years after completion of sentence. Beyond a violent felony the only thing i know for sure again in fl and federal levels they will revoke 2nd amendment rights for is any form of domestic violence even if its not at felony level, so if you don't have that you should be golden :)

on a second not i too will be trying to get my ccl here once i can stop spending all my money on my car lol

A DUI would have excluded me from working at Marathon. That being said, I have a clean record and was unfortunately able to pass the drug tests and background checks.

Wow, i didn't realize so many people posted here since I last checked. As for the probation, it was a little strange. Although I was on probation I never had to check in or anything like that... pretty much had to have no run in with the law for 6 months. This was in MA but I had to return to Hawaii because I was on 2 weeks of leave. So thats how that came to be.... I really need to get off my butt and file an appeal for all of this!

File it! And check to see if there are Advocates to assist. Many Administrative Appeal procedures will have trained advocates available at no cost to you.

Well after search a couple crimal background website (I know, probably a waste of money) I came up with no criminal records on both websites... both sites had accurate address from the last 7 years... I can't really trust the information posted there but its still like WTF!? i am tempted to go to another store and run my info again to be sure. I have read that some people have denied issues on fridays... thats when I put my information through.... worth a shot (no pun intended).... then to the local police or state police if that fails.....

Start here: NICS Appeal. A friend of mine was denied because of a mix-up with someone of the same name. Were you told it was due to the DUIs? The older NICS system just came back with a yes or no with no explanation.

Well it turns out that after a 2nd attempt at a NICS application I was DENIED yet again. This time when I called the lady on the other end said that they can not release information over the phone. Long story short.... I am a NH resident and had a DUI in June 2006 in MA with a MA license (before I became a NH resident). So that being said, one of the automatic disqualifiers is having a DUI in MA.... even though I am in NH.... Anyone else confused? Yea, so am I... still like WTF!?

So digging a little deeper I found that I can not expunge my criminal record of the DUI in MA at all.... which means that I can NEVER own a gun legally... unless I move to Texas... which is still a 50/50 chance.... Just one of those things I guess... time to start a white house petition?

run for NH government. Don't they have 10,000 reps? Change the state law!

If one of your DUIs was a felony (punishable by serving a year in prison) or a state misdemeanor punishable by serving two years in prison, you cannot purchase a firearm in any state through a FFL. The key here is what time you could have served not what your sentence was.

If neither of your DUIs fall into the above catagories, then MA may have misreported your convictions or there could be some other screwup. In any case, if NICS has you flagged it will stay that way until you start the appeal process (see link in previous post) and get things cleared up.

Edit: In the state of MA, the punishment for a OUI is up to 2 1/2 years MA oui Brochure.pdf. This will affect your abilty to purchase a firearm through an FFL. NICS Fact Sheet (scroll down to "Federal Categories of Persons Prohibited From Receiving")

That's about as absurd as someone being put on the sex offender list for urinating in public.

I won't be able to buy a handgun either because of some BS that happened way back when I was 16... in fact, I tried to enter the Navy but they wouldn't take me because of that same BS. (I don't feel like sharing details... didn't involve breaking any laws though)

I think I can still buy a shotgun or a rifle though... but I'd rather have a handgun. :/

Really sucks though that you actually DID serve for our country and our freedoms, but you're disallowed one of the very freedoms you fought for.

Thank you for serving our country.
