So i dunno how it is in the US but here in canada its screwy. Heres my atory. So I just got a call from my adjustor dealing with my claim. They say they are not covering my loss (written off car) WTF!!!! Because the car was modified and they claim I left them in the dark about it?!? When I signed up for my insurance they asked have I modified my car over $5000? No I haven't was my response. I maybe have $3000. So now they r saying I don't get a penny and I have to pay for storage and tow fees of $890!!!! I'm sooooo pissed right now. So now i owe $14,000 still on my balt and just bought a brand new car...i won't be able pay for both very long. On the bright side I have a really good insurance broker and he is doing all the leg work contacting the insurance company and superviors to crack some skulls. Last case senerio it gonna come down to getting me a lawyer to fight these ****ing idiots.

Not sure how it works in Canada, but in the US each state has their own department of insurance who essentially allows insurers to write policies and handle claims in that given state. If you guys have something similar I would file a complaint before you go to an attorney. Remember an attorney is going to take a % of whatever you get from the insurance company so you will be out of pocket that % if the adjuster rolls over and pays the claim.
Based on what you have stated it sounds like they are going with the material misrepresentation route...meaning they claim you misrepresented yourself at the time you applied for the policy. In these cases they would typically refund your policy premium. Demand your insurance company send you any and all policy documents (including the application) that support the denial.
Is the car a total loss? What dollar amount are we talking about? If you have a lien holder on the car (i.e. the bank that financed the car) you should get them involved immediately if the car is still sitting in a tow yard.

Oh and dollar amount. They say $5800 in damage. And I was gonna go down to $10,000 as my final number but start at $14,000 the amount owing. And $10,000 for the market in my area is a very reasonable number. I can find 9 ranging from $10,000-$12,500 and only 2 have less kms then my car.....
