Parking lot incident

My wife was driving through our apartment parking lot and a Fiesta backing out backed into the passenger side of my black Sonic. The damage isn't too bad, but I'm pissed regardless.

Hopefully the other driver's insurance will cover everything and I won't be responsible for a deductible.

Has anyone had a parking lot accident before? How did it turn out?

I don't know what it's like where you are, but in Indiana, most parking lots are considered private property, and when an accident happens in one, both parties pay for the damages to their own vehicle.

Not sure about Missouri. An officer did come out to take a report though. I've heard that in some areas, officers will not even come out to take a report if it happens in a parking lot.

Don't know about parking lot incidents, but I have heard when a vehicle is backing up during an accident, the vehicle backing up is at fault.

Parking lot or not the person in fault pays for it. You should not have to pay a deductible.

Looking at it again, it's not as bad as it looks. It doesn't look like much, if any paint chipped. Looks mostly like scuff marks. However, there is a dent.

I backed into a guys car in heavy rain. It was my fault. I gave him my info and we were on our way.

usually not sure your state but if your 3/4 the way backing out, you have the right of way and someone hits you driving through the parking lot its their fault, but if they back into you of course its their fault, but in most cases parking lot accidents both parties are at fault and pay for there own damage,

From the pic it looks like his wife was just about past he car when it landed the bumper just forward of the rear passenger wheel. I think the "3/4 the way out" rule is lost in this instance. The only way I could see this being the attrapereves' wife's fault is if she was hauling A through the parking lot.

My wife saw the reverse lights and the car starting to back out right about the time she got up to it. She honked the horn, but the driver was either not paying attention or did not have enough time to stop before hitting the Sonic.

This happened with my older car. A driver was coming around a corner and by the time I saw him, it was too late. Luckily both of our crappy cars already had damage, so we just agreed to drive off.

Update: I filed a claim through my insurance, but they are saying that the other driver is at fault. I am currently filing a claim through the other drivers insurance.

I was able to get most of the markings off the rim. Most of it was plastic residue from the other car's bumper. However, the door has a dint and some scuff marks. Hopefully it won't need to be repainted and can be buffed out.

That's going to be painted...
They are going to have to fix the dent, either pull it out or take the door apart and push it out, sand and fill the door so its smooth, and then paint it.

Not always true....

In Wisconsin, I was backing my car out of a parking spot and was 100% out of my parking spot and at a dead stop when I was rear ended. A girl was texting and driving....

Anywhoo, after the insurance battles I was actually found to NOT be at fault for I was over 50% out of my parking spot.

As for parking lots, it's always a tricky area and laws change from state to state. It may be worth mentioning that I took COUNTLESS pictures before moving my car or hers. Also, a copy of the parking lot surveillance video was acquired as well.

thats great no out of pocket, just make sure you show the pictures to whoever is doing the repair and say you want to keep the wheel if they replace it,

I was in with my sonic about 7 months ago, always ask if the lot has cameras. The one I was in had a camera and the other party was found to be 100% at fault

It was my apartment parking lot, so no cameras. The other driver already admitted fault. My wife saw the reverse lights as she got up to the car, but the car was not moving. My wife saw her head turned to the rear and honked the horn as she began to back up, but I guess she couldn't react quickly enough.

There's no way the car was more than 50% out of the spot by the time my wife got up to her, otherwise the Sonic would have been hit near the front or middle. The damage to the other vehicle is on the driver side rear bumper. Funny enough, there was already damage done to the bumper of her car as she had gotten in another accident just a few weeks before.

My insurance already told me that my wife is not at fault, hence the reason I filed a claim with the other insurance company.

UPDATE: The other drivers insurance is taking full responsibility. I got a quote and they quoted around $1500 for the damage. These things sure add up.

Sanding the door, repainting it, fixing the rim, and also performing a rear alignment.

Car is in the body shop. It is expected to take 4 days for repair.

My wife was given a Hyundai Accent for a loaner.

It is probably the cheapest feeling car I've ever been in. Worst of all, the engine was revved up to over 2,000rpm while warming up for close to 10 minutes.

As luck would have it, the car wouldn't start this morning because of a weak battery. They swapped it with an LT Sonic sedan, lol
